redBus wants to sue for mentioning their brand name? [Pluggd.in Forum]

From Pluggd.in forum and for the context, Sameer Parwani is the founder of Coupondunia.

I use to think redBus was a well-run company, but that is eroding. First of all a few months back they ran an affiliate program through the OMG affiliate network. Publishers racked up sales for redBus but then redBus decided to not pay 95%+ of the sales from my understanding. That’s really unusual because if a merchant feels they aren’t getting good value out of an affiliate program they end it immediately. They don’t mislead publishers into promoting their site and then tell them after the fact that they aren’t going to pay.
Now just today, in a totally unrelated matter, I got the following legal threat from redBus’s Head of Marketing saying we are mentioning redBus’s brand name without written approval. This is asinine because it is legal to write/speak about a brand as long as you aren’t impersonating the brand or doing some of unjustified damage to the brand. Is it illegal for MouthShut to list redBus reviews without redBus’s permission? And even besides that, the email is asinine because these guys did essentially give me approval to create that page when they promoted their affiliate program via OMG to sites like mine. But I don’t need their approval anyway. This is almost as stupid as Yahoo suing Facebook over those patents.

Here’s the email chain so far (read from bottom to top – oldest email is at bottom):

Cool. Let me know how a Head of Marketing has so little common sense while you’re at that?

Will ask the lawyer to take this discussion forward. Thanks.

You think people can only say “redBus” with written approval? Then I guess you have a long list of sites you need to file suit against. Here you go start with this link: http://www.google.co.in/#q=redbus

Hi Sameer.
I wanted to check with you regarding this page: http://www.coupondunia.in/redbus
Have you got any kind of written approval from redBus to mention our brand name? If not, I’ll have to share this case with my lawyer who’ll proceed with a notice and a legal action for using our name without our consent.
Best regards,
