US Government Rules AI-Generated Images From Text Cannot Be Copyrighted

  • US Copyright Office (USCO) has ruled that any images produced by giving a text prompt to current generative AI models cannot be copyrighted in the US.
  • USCO equated such prompts to a buyer giving directions to a commissioned artist.
  • USCO stated that these prompts identify what the prompter wishes to have depicted, but the machine determines how those instructions are implemented in its output.
  • The ruling was published in the Federal Register.
